BOWMAN, Circuit Judge.

Ronald C. Keller ("Keller") appeals a grant of summary judgment by the District Court1 in favor of Bass Pro Shops, Inc. ("Bass Pro"), and the denial of his cross-motion for summary judgment. We affirm, although our affirmance is on grounds different from those relied upon by the District Court.
