COX, Circuit Judge:

Russell Charles Dailey was convicted on one count of violating 18 U.S.C. § 1952(a)(3) (1988 & Supp. II 1990), interstate travel with intent to carry on the unlawful activity of extortion, in the Northern District of Alabama in September 1992. In a recorded telephone conversation earlier that year, Dailey told the victim that he would "make sure you never walk again" if the victim did not repay money he owed Dailey.
