This is an immigration case in which the petitioner is an alien who faces deportation on account of a 1985 drug trafficking conviction for which he served more than five years in prison. The petitioner applied for a discretionary waiver of deportation under § 212(c) of the Immigration and Nationality Act, 8 U.S.C. § 1182(c), but he was held to be ineligible for such a waiver because of a proviso that was added to § 212...
