Defendant Charles Hacker moves to dismiss Counts 1 and 4 of the Second Superseding Indictment, and the remaining defendants jointly move to dismiss Counts 1, 2, 7, and 8 of the Second Superseding Indictment. All defendants argue that the Sisseton-Wahpeton Sioux Tribe and other Indian tribes mentioned in the Second Superseding Indictment legally obtained title to federal excess property under the Indian Self-Determination...
