FARRELL, Associate Judge:

This appeal from a grant of summary judgment in favor of the District of Columbia Board of Elections and Ethics (the Board) presents the question whether a proposed ballot initiative, D.C.Code § 1-1320 (1992), that would prohibit the District government from "booting" and thereby impounding motor vehicles as a fine-collection measure and would also require an "amnesty ... from time-to-time"...
