This is an appeal from a summary judgment.

Wayne Jacks worked as a police officer for the City of Birmingham (City) from July 29, 1960, until February 28, 1981, when he retired from active service under the City's "supplemental retirement pension plan." On August 14, 1990, Jacks transferred from the supplemental plan to the "regular service retirement pension plan."
