POWERS, Justice.

The State of Texas appeals from a summary judgment obtained by First Interstate Bank of Texas, N.A., in the State's condemnation suit against land upon which the bank held a mortgage lien. We will affirm the judgment.

THE CONTROVERSY

Crossroads, Inc., owned in fee simple certain land in Williamson County and had given the Bank a mortgage lien on the land to secure Crossroads' debt to the bank in the amount of $3,214,788.
