This is an appeal from the grant of a summary judgment in favor of plaintiff-appellee, Port Aggregates, Inc., and against defendant-appellant, Woodrow Wilson Construction Company, Inc. (hereinafter referred to as Woodrow Wilson) and the Fidelity and Deposit Company of Maryland.
