On 10 November 1993, Edward Stokes ("Stokes") was indicted by a Federal grand jury on three counts of a four-count indictment (the "Indictment"). Count one of the Indictment ("Count One") charged Stokes with carjacking—taking a motor vehicle from another person by force, intimidation and violence while possessing firearms—in violation of 18 U.S.C. § 2119.
