This case comes before the court on Trigg's motion to dismiss the indictment, pursuant to Fed.R.Crim.P. 12(b). (Doc. 20)

Trigg was arrested on the premises of Robinson Junior High School in Wichita, Kansas, on September 24, 1993. At the time of his arrest, an unloaded .25 caliber semiautomatic pistol was found in his possession. Trigg was thereafter indicted for possessing a firearm on school property...
