Decedent, Kevin Leger, was killed while working for defendant, Hardy Rice Drier, Inc. Plaintiffs, decedent's wife and child, brought an action in tort against defendant for decedent's wrongful death. Defendants subsequently filed a motion for summary judgment, contending that defendants were immune to tort liability by virtue of the Louisiana Workers Compensation Act.
