PEOPLE v. WATSON

No. 93CA0565.

892 P.2d 388 (1994)

The PEOPLE of the State of Colorado, Plaintiff-Appellee, v. Steve WATSON, Defendant-Appellant.

Colorado Court of Appeals, Div. IV.

Rehearing Denied September 15, 1994.

Certiorari Denied April 3, 1995.

Attorney(s) appearing for the Case

Gale A. Norton, Atty. Gen., Stephen K. ErckenBrack, Chief Deputy Atty. Gen., Timothy M. Tymkovich, Sol. Gen., Catherine P. Adkisson, Asst. Atty. Gen., Denver, for plaintiff-appellee.

David F. Vela, Colorado State Public Defender, David M. Furman, Deputy State Public Defender, Denver, for defendant-appellant.

Opinion by Judge DAVIDSON.

Defendant, Steve Watson, appeals from a judgment of conviction entered on a jury verdict of guilty of second degree assault on a prison official. He contends on appeal that a prior prison disciplinary proceeding and accompanying sanctions bar subsequent criminal prosecution under principles of double jeopardy. He also alleges instructional error. We disagree with both of these contentions and affirm.
