Petitioner John Walter Castro, Sr. has appealed to this Court from an order of the District Court of Noble County denying his application for post-conviction relief in Case No. CRF 83-70. Petitioner's first degree murder conviction and death sentence were affirmed by this Court in Castro v. State, 844 P.2d 159
