MEMORANDUM OPINION AND ORDER

SPRIZZO, District Judge.

Defendant Elmer Martinez moves for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure, based on qualified immunity. For the reasons that follow, the motion is granted.
