Plaintiff, Roger Dale Carter (Carter), and intervenor, Aetna Casualty and Surety Company (Aetna), appeal a directed verdict dismissing plaintiff's case. The issues presented on appeal are: (1) whether the trial judge applied the correct standard in granting defendant's motions for directed verdict; and, (2) whether the plaintiff's evidence is so insubstantial that the case should have been removed from the jury.
