Kusy, appeal from (1) the Superior Court's grant of summary judgment in favor of the defendant, the town of Millbury (town), and the denial of the plaintiffs' motion for summary judgment, and (2) a declaration that the town did not violate any provision of G.L.c. 32B (1992 ed.).
