After an evidentiary hearing, the third district court found that Jeffrey Vere Vincent was not indigent under sections 77-32-1 and 78-56-8 of the Utah Code. It therefore denied Vincent's request for court-appointed counsel and a free transcript on appeal from his theft conviction. The court of appeals reversed, finding that Vincent was indigent. State v.
