BROOKSHIRE, Justice.

Appellant, Paul Dean Napier, was indicted for the offense of aggravated sexual assault and after having pleaded guilty, evidence was then submitted to a jury by the State and the appellant for the purpose of assessing punishment. The jury found the appellant guilty as instructed by the court and assessed punishment of appellant at 40 years imprisonment in the Institutional Division of the Texas Department of Criminal Justice...
