Defendants former Police Commissioner Lee Brown ("Brown"), Rae Downes Koshetz ("Commissioner Koshetz"), the New York City Police Department ("NYPD") and the City of New York (the "City") (collectively, the "Defendants") have moved for an order of summary judgment, pursuant to Rule 56, Fed.R.Civ.P., against the Plaintiff Steven Schwartz ("Schwartz").
