MEMORANDUM OPINION

LATCHUM, Senior District Judge.

I. INTRODUCTION

On December 16, 1993, the grand jury for the District of Delaware returned a four-count indictment against defendant Keith Murcer (a.k.a. Keith Mercer, a.k.a. Sholomo Ben Yisrael) for: (1) knowingly possessing with the intent to distribute more than 5 grams of a substance containing a detectable amount of cocaine base ("crack") in violation of 21 U.S.C. § 841(a)(1);
