BACKGROUND AND PROCEDURE

On January 2, 1992, William D. Moore (Moore) was arrested and charged with first degree murder in connection with the killing of his wife, Joanne Sousa Moore (Mrs. Moore). Prior to trial, both Moore and the State moved the trial court for a psychiatric evaluation to determine whether Moore was competent to stand trial.
