James and Marian Mason appeal a final judgment entered in favor of Dr. Charles D. Bisogno in their medical malpractice suit. The trial judge granted Dr. Bisogno's motion for summary judgment based upon the expiration of the statute of limitations. The quagmire in this case is created by alleged conflict between sections 766.106(3) and 766.106(4), Florida Statutes (1991), and Florida Rule of Civil Procedure 1.650(d)(3).
