OPINION

HAROLD A. ACKERMAN, District Judge.

This matter comes before the court today upon a motion by defendants, the National Broadcasting Company, Inc. ("NBC") and its subsidiaries, WNBC-TV, WRC-TV, and CNBC,1 for summary judgment pursuant to Federal Rule of Civil Procedure 56. For the reasons detailed below, defendants' motion is granted in part and denied in part.
