OPINION

DUGGAN, Justice.

This is an appeal from a take nothing summary judgment in a usury case. The trial court found as a matter of law that the transaction between appellant, Sidney Ravkind, and appellees, Mortgage Funding Corporation (MFC) and Chrysler First Financial Services Corporation (Chrysler), was an assignment of payments due under a note, and not a usurious second mortgage loan.
