Defendant Kenneth W. Waters was charged with domestic abuse assault, in violation of Iowa Code sections 236.2 and 708.2(3) (1991).

The charge arose from an incident on October 17, 1991. Defendant and his girlfriend, Pamela Sue Lenger, had been staying for a few days in a trailer which was parked near the home of defendant's father in Eddyville, Iowa.
