Appellant, John Leon Price, was convicted by a jury of the offense of capital murder. See Tex. Penal Code Ann. § 19.03(a)(2) (Vernon Supp.1994). The State waived the death penalty, so that the punishment of confinement for life in the Institutional Division of the Texas Department of Criminal Justice was automatic.
