Plaintiff, an employee of third-party defendant R.V. L. Contracting, Inc. (hereinafter RVL), sustained a serious injury to his right arm when, while working as a flagger on a construction site, he was hit by a metal object. At the time of the accident, third-party defendant Richard V. LaVoy, the owner of RVL, was operating a pavement cutting saw which was equipped with a diamond-tipped saw blade.
