EXUM, Chief Justice.

On 20 April 1992 defendant was indicted for the murder of his wife. Defendant was tried noncapitally, found guilty of first-degree murder, and on 15 December 1992 he was sentenced to life imprisonment.

Defendant and his wife, Karen Hardy, were married on 4 July 1980. They had two children together and Karen had a daughter from a previous marriage. They opened a restaurant, the Mountaineer Restaurant...
