The defendant, Vincent Gatling, filed a motion to dismiss this indictment pursuant to CPL 30.30 alleging that he has been denied his right to a speedy trial. The defendant contends that 189 days of excludable time have elapsed within which the People were not ready for trial. The People countered that only 106 days chargeable to them have elapsed.
