W. WASTE INDUS., INC. v. CATALOG PUBLISHING GROUP, INC.

No. 94-1172.

637 So.2d 386 (1994)

WESTERN WASTE INDUSTRIES, INC., a Florida corporation, Petitioner, v. CATALOG PUBLISHING GROUP, INC., a Florida corporation, Respondent.

District Court of Appeal of Florida, Fifth District.

June 10, 1994.

Attorney(s) appearing for the Case

F. Scott Pendley and Donovan A. Roper, Dean, Ringers, Morgan & Lawton, Orlando, for petitioner.

No appearance for respondent.

GRIFFIN, Judge.

Petitioner seeks certiorari review of an order denying it summary judgment. To establish the element of irreparable harm, petitioner asserts that because of the size of the claim, its limited excess insurance may be exhausted, thereby exposing it to unwarranted inquiry into its assets and trade secrets if respondent obtains a judgment. This does not meet the test for irreparable harm.

PETITION DENIED.
