Appellant was convicted by a jury of delivery of less than four ounces but more than one-iourtn oi an ounce oi marijuana. The jury assessed punishment at two years in the Texas Department of Corrections and a $2000 fine. The conviction was affirmed by the Tenth Court of Appeals in an unpublished opinion. Daniell v.
