Presently before the Court is a motion to dismiss Plaintiff, Horace L. Brawley's civil rights complaint. (D.I. 11). On April 12, 1991, Plaintiff filed a civil rights complaint pursuant to 42 U.S.C. § 1983 against Guy Sapp, Wilmington City Police Chief, Officer Jannuzzio, and Officer Kane, patrolmen employed by the City of Wilmington Police Department.
