This appeal arises from a petition filed on behalf of B & S Equipment Company, Inc. (B & S), plaintiff/appellee, against four defendants, one of which is Carl E. Woodward, Inc. (Woodward), defendant/appellant. B & S, the contractor, filed suit against Woodward, the subcontractor, for breach of the construction contract. Woodward now appeals the granting of a partial motion for summary judgment in favor of B & S in the amount of $12,188...
