STATE of Florida, Appellant, v. Philip E. SUCENA, Appellee.

District Court of Appeal of Florida, Second District.

PER CURIAM.

The state appeals an order dismissing, on double jeopardy grounds, a charge of driving under the influence of alcohol. This appeal is controlled by our recent decision in State v.
