On April 30, 1991, plaintiff-appellant Case Western Reserve University filed a complaint against defendant-appellee Yellow Freight System, Inc.

In its complaint, appellant stated that in mid-December 1989, it retained the services of appellee, in order to transport by truck a Lexel Model 95 Ion Laser and Power Supply. Appellee was to transport the laser and power supply from the U.S. Army's Chemical Research, Development and Engineering...
