Roger N. Desjardins ("plaintiff") brings the instant action against the Department of the Navy ("defendant") pursuant to the Federal Tort Claims Act ("FTCA"), 28 U.S.C. §§ 1346(b), 2671 et seq. Plaintiff alleges that as a result of the Navy's negligence, he was arrested and confined by the Navy under charges of desertion at a time when the Navy was barred from bringing such charges against him...
