Nicholas Hassapelis appeals from a judgment entered on his murder conviction, following a jury trial in the Superior Court (Oxford County, Perkins, J.). His sole contention on appeal is that the court erred by allowing the State to read to the jury a transcript of the deposition testimony of medical examiner Dr. Ronald Roy without first determining his unavailability as a witness at the time of trial.
