HOLCOMB, Justice.

Appellant appeals his conviction of murder by a jury and its assessment of punishment of ten years imprisonment.

Appellant has assigned seven points of error. By his first point of error, Appellant contends that the evidence is insufficient to sustain a verdict of guilty for the offense of murder. Billy Ray Horton, Thomas E. Ladner, and James M. Hyden were indicted separately but tried jointly for the murder of Loyal Garner, Jr.
