DAUGHTREY, Justice.

We granted review in this criminal case to determine what effect an expunction order, entered after a preliminary hearing, has on the prosecution of a subsequent indictment for the same offense. Specifically, we are asked to decide whether copies of documents that were destroyed pursuant to the premature expunction order can be utilized by the prosecution at trial on the subsequent indictment.
