The plaintiff, Nick Lonigro (Lonigro), sued the defendants, Penny Cab Company (Penny Cab), George Lockett and James Benecke, to recover for personal injuries he sustained in an automobile collision. The jury found Benecke not liable and found that Penny Cab and Lockett were liable in the amount of $40,000. (We will refer to Penny Cab and Lockett collectively as Penny Cab.)
