Appellant filed a complaint against defendant on 6 April 1990 to recover damages for injuries arising out of an automobile accident which occurred on 8 April 1987 in Wake County, North Carolina. A civil summons appears to have been issued the same day and returned upon certification that defendant was not to be found in Wake County.
