The defendant was charged in the first indictment with theft, over one thousand dollars ($1000) but under ten thousand dollars ($10,000). Approximately one month later he was reindicted for the same offense. He was found guilty at a jury trial and was sentenced as a Range III persistent offender to eight (8) years in the Department of Correction and fined one thousand dollars ($1000).
