Evelyn M. Roberts, the appellee, brought a suit in equity to set aside a promissory note and deed to secure debt, against A. Roberts Corporation and her former husband, Jesse Roberts, the president and sole shareholder of the corporation. The case was tried before a trial judge sitting without a jury and on March 22, 1991, the court granted the appellee's petition to set aside the note, finding that the promissory note was executed by the appellee...
