In this action for negligence and breach of contract, plaintiff appeals as of right from a December 3, 1990, Oakland Circuit Court order granting defendant's motion for summary disposition pursuant to MCR 2.116(C)(8) and denying plaintiff's motion for leave to file a second amended complaint. We affirm in part and reverse in part.
