Defendant, Elmer Lee Richardson, was charged by bill of information with five counts of attempted first degree murder in violation of LSA-R.S. 14:27, 14:30.1 He was arraigned on April 4, 1991 and pled not guilty. Prior to the commencement of trial on March 17, 1992 the State entered a nolle prosequi as to three of the five counts and defendant went to trial on the remaining two.
