This appeal presents the legal issue of whether Act 130 of 1990, amending La.R.S. 22:1386, applies retroactively to an accident which occurred on April 16, 1990.

Dean Brunies was injured in an automobile accident when he was struck in the rear by an automobile driven by John Guillet which had been struck in the rear by an automobile driven by Curlan Guillory. Brunies filed suit against Guillory, his insurer, Automotive Casualty Insurance...
