This simple but bothersome case comes before the Court on cross motions for summary judgment. Pursuant to Fed.R.Civ.P. 56(b), summary judgment shall be granted upon a showing "that there is no genuine issue as to any material fact and that the moving party is entitled to a judgment as a matter of law."
