This is an appeal from a default judgment.

Plaintiff, Judy Ann Smith Joseph, filed for divorce on June 29, 1989. A preliminary default judgment was entered on September 11, 1989, and a divorce by default was granted on September 28, 1989. Thereafter, plaintiff filed an action to partition the community property on November 27, 1990. It appears that the defendant was served on December 10, 1990, and failed to answer the petition.
