Presently before this Court are the preliminary objections of the Pennsylvania Department of Transportation (DOT) to the petition for review of Carl W. Ruby (Ruby) filed in our original jurisdiction.1

On July 15, 1990, Ruby was convicted of violating Section 3731 (driving under the influence of alcohol or a controlled substance) of the Vehicle Code, 75 Pa.C.S. § 3731. Ruby's operating privileges were suspended...
