The People of the State of New York, Respondent, v. Sean James, Appellant

Appellate Division of the Supreme Court of the State of New York, Second Department.

June 1, 1993

Ordered that the judgment is affirmed.

Contrary to the defendant's contentions, we find that there was probable cause for his arrest. It is well settled that "[a]ny inquiry into the propriety of police conduct must weigh the degree of intrusion it entails against the precipitating and attending circumstances" (People v Salaman, 71 N.Y.2d 869, 870; see also, People v De Bour, 40 N.Y.2d 210
